Terms of Use for BIM Consultancy Services

Welcome to BIMable! By purchasing our BIM consultancy services, you agree to the following terms and conditions. Our full name is Beaconx Limited which is a company incorporated in England with company number 14815109 and having its registered office at 7 Elmside Road, Wembley, England, HA9 8JB.

Service Scope
Our BIM consultancy services include, but are not limited to, the provision of the BIM Surgery, Starter Pack, Project Reviews, and Training together with further services described on our website (“Service(s)”). The specific details of each Service will be outlined in the proposal document provided to you (“Proposal”).

Payment and Fees
The fees for our Services are as set out on our website unless otherwise set out in a Proposal (“Fees”). Our Fees are exclusive of VAT and shall be paid in advance unless otherwise agreed in our Proposal. If you do not pay us for our Services when you are supposed to, we have the right to suspend or restrict supply of the Services until you have paid us. Late payments may incur interest charges at the rate prescribed by law. All Fees are non-refundable unless stated otherwise in these terms.

Cancellation & Rescheduling
To cancel or reschedule your booking for Services, please provide at least 24 hours' advance notice. To do so, reply to your booking confirmation email with 'Reply All,' specifying the new date and time you'd like to reschedule. Rescheduling within the 24-hour window before the session will result in you having to pay the full amount of Fees for the Services. Thank you for your understanding and cooperation.

No-Shows & Late Arrivals
No-shows will result in you having to be charged the full amount of Fees. If you arrive late to your session, the session will not be extended; instead, the remaining time will be available for the consultation. Thank you for your cooperation and understanding.

Your Obligations

In addition to any of your responsibilities specified in a Proposal, you will provide us with all necessary information reasonably required by us to provide the Services in a timely manner and in accordance with the Proposal. You will keep us informed of all material developments or proposals that may affect the delivery of the Services.  You understand that we will not be responsible if the information you provide is inaccurate or if you do not provide the information we request in a timely manner.

 

You will obtain and provide all necessary consents and licenses which are required to provide the Services and you agree to comply with all applicable laws in connection with your obligations under this agreement.

 

You will take all reasonable precautions to ensure the health and safety of our staff or any of our consultants if they are on your premises.

 

Risk & Liability

We operate as a platform and facilitate the provision of the Services to you by third party consultants (“Consultants”). You acknowledge that the Services will be provided by Consultants. The Supplier makes no representation, warranty or commitment and shall have no liability in relation to services provided by them.  Thank you for your cooperation and understanding.

The Services that we provide will be provided with reasonable skill and care. However all other warranties, conditions and representations which are implied by law are excluded. 

 

We do not exclude liability for death or personal injury caused by our negligence or for any other matters that we are unable to exclude liability for under applicable law.

 

We have no liability to you for any loss of business, loss of profit, loss of income, for any business interruption, loss of opportunity, loss of or corruption of data, loss of goodwill or for any indirect and consequential loss arising from our agreement.

 

Our maximum liability to you for all claims arising under our agreement (whether such liability arises due to negligence, breach of contract, or for any other reason) is limited to the amount you have paid us in Fees in the 12 months preceding your claim.


Confidentiality
Your privacy is our priority. Discussions during your one-on-one session, including files, photos, or recordings, may be used internally for training and quality assurance. Otherwise, your information will remain confidential and not shared externally without the consent of all parties involved.

Intellectual Property
All intellectual property in any materials, designs, and other deliverables created by BIMable and/or Consultants remain the property of BIMable or Consultants, as applicable. You are granted a limited license to use them for your project (“Developed IP”). You may not reproduce, distribute, or modify Developed IP without our permission. We grant you a non-exclusive, non-transferrable right to use the Developed IP for the purpose of receiving and enjoying the Services.

Project Timelines
We will work with you to establish project timelines and milestones. While we strive to adhere to agreed-upon timelines, we are not responsible for delays beyond our control. 


Termination
Either party may terminate this agreement on 30 days’ notice. In the event of termination, you agree to pay all Fees outstanding for Services rendered up to the termination date.

 

We may also terminate this agreement immediately if you are in material breach of our agreement and the breach cannot be remedied or where it can be remedied, you fail to remedy the breach within 7 days of us notifying you in writing that you need to do so. 


Dispute Resolution
Any disputes arising from these terms will be resolved through negotiation. If resolution cannot be reached, disputes will be settled in the English courts and subject to English law.

Amendments
BIMable reserves the right to modify these terms and conditions at any time. Changes will be communicated to you in writing. Unless you object to such modifications within 30 days, the modified terms will be deemed to apply. No other changes to these terms will apply unless otherwise agreed in writing.

Negative Behaviour
We prioritise respect and safety in all interactions. We understand that customers can occasionally get frustrated if they experience problems with the services we provide. However, you must always treat our people with dignity and respect. You must not treat our staff in a way that is abusive, threatening or otherwise disrespectful. If you encounter anyone (whether a Consultant or otherwise) who violates these values, please report it to us promptly. We will initiate an investigation and take the necessary actions to address the situation. Thank you for helping us maintain a positive and safe community.

 

Matters beyond our reasonable control

We are not liable or responsible for any obligations under our agreement which occur due to things or matters beyond our reasonable control.

 

 

Other Terms

Any terms of this agreement which from their nature or context it is contemplated that they shall survive such expiration or termination shall survive expiration or termination.

 

This agreement including the Proposal is the entire agreement of the parties and supersedes all prior agreements, negotiations, representations, and proposals relating to the subject matter.

 

 

Feedback and Complaints

We strive to make your experience with your consultant both rewarding and insightful. If you find that the Services provided are unsatisfactory, please email us at admin@bimable.co.uk. We will review your message and respond within 72 hours with the next steps. We welcome your feedback to improve our services. If you have any complaints, please notify us promptly, and we will work to resolve them. Your feedback is valuable to us. Thank you for helping us improve!
